Terms of Service

These Terms govern your use of Niutoyu. They explain what we do, what you can expect from us, and what we expect from you. Please read them carefully — by using the service, you agree to them.
1. Acceptance of these Terms
These Terms of Service (“Terms”) form a binding agreement between you and Niutoyu(“we”, “us”, “our”), a marketplace operator based in Accra, Ghana. By creating an account, listing an item, or purchasing through Niutoyu, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy.
If you do not agree, you must not use the service.
2. The Service
Niutoyu is a consumer-to-consumer (C2C) marketplace that lets individuals in Ghana list, buy, and sell pre-loved fashion items. We provide the platform — listings, search, messaging, payment processing through Paystack, and our Buyer Protection programme — but we are not the seller of items listed by users, except where explicitly stated.
Items are bought from and sold by other users. Each transaction is a contract between the buyer and seller; we facilitate it.
3. Eligibility
To use Niutoyu you must:
- Be at least 18 years old, or the age of majority in your jurisdiction;
- Be capable of entering into a legally binding agreement under Ghana law;
- Reside in Ghana or have a valid Ghana mobile money or bank account where required;
- Use the service only for lawful purposes consistent with these Terms.
4. Your Account
You sign in using your Ghana phone number (SMS OTP) or your email (magic link). You are responsible for keeping your sign-in method secure and for all activity under your account.
The information in your profile — including your display name, payout details, and shipping address — must be accurate. You agree to update it promptly when it changes.
5. Listing Items
If you list an item, you confirm that:
- You own the item and have the right to sell it;
- The item is genuine and accurately described — condition, size, brand, and material match the listing;
- The photos are of the actual item, not a stock image, unless the listing makes that clear;
- The item is not on the prohibited list (Section 9).
We may remove a listing or suspend an account if a listing breaches these Terms, applicable law, or another user's rights.
6. Buying & Payment
Prices on Niutoyu are quoted in Ghana Cedis (GHS). When you tap Buy, you pay the item price plus the Buyer Protection fee shown on the product page.
Payments are processed by Paystack. You may pay using a Ghana mobile money wallet (MTN, Vodafone, AirtelTigo) or a Visa/Mastercard. We do not store full card details; payment processing follows Paystack's PCI-compliant flow.
Your payment is held by us until you confirm delivery (or until 7 days after the seller marks the item as shipped, whichever comes first). At that point we release the funds, less applicable fees, to the seller's payout method.
7. Buyer Protection
Every paid order is covered by Buyer Protection. If the item never arrives, or arrives substantially different from the listing (counterfeit, wrong size, undisclosed damage), you may open a dispute within 7 days of the seller marking the order as shipped.
We will review the dispute. If the claim is upheld, we refund you in full. The Buyer Protection fee covers the cost of operating this guarantee.
8. Shipping & Delivery
Sellers are responsible for shipping items domestically within Ghana using a method of their choice. Sellers should provide a tracking number or proof of dispatch when marking the order as shipped.
Delivery times depend on the courier and destination. Niutoyu does not currently offer integrated shipping; that may change.
9. Prohibited Items & Conduct
You may not list, sell, or attempt to acquire:
- Counterfeit, replica, or stolen goods;
- Items in restricted categories under Ghana law (firearms, explosives, regulated drugs, hazardous materials, ivory and other restricted wildlife products);
- Used underwear, used swimwear, or other items contrary to public hygiene standards;
- Items that infringe a third party's intellectual-property rights;
- Anything else listed in our Help Centre as prohibited from time to time.
You also agree not to:
- Use the service to defraud, harass, or impersonate;
- Move payment off-platform to avoid fees or Buyer Protection;
- Scrape, reverse-engineer, or otherwise interfere with the service;
- Create multiple accounts to circumvent suspensions or limits.
10. Fees
Buyer Protection is paid by the buyer at checkout and is shown before payment. Listing items is free. Optional “Bump” packages — paid promotions that raise a listing's position in the catalogue — are charged separately and shown before purchase.
We may change our fees with reasonable notice. Changes will not apply to transactions already in progress.
11. Content & Intellectual Property
You retain ownership of the photos, descriptions, and other content you submit. By submitting it, you grant Niutoyu a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and promote it for the purpose of operating the service.
The Niutoyu name, logos, design system, and software are our intellectual property. You may not use them without our written permission.
12. Suspension & Termination
We may suspend or close your account, or remove listings, if we reasonably believe you have breached these Terms, applicable law, or the rights of others. Where possible we will give you notice and a chance to respond, but we may act without notice in cases of fraud or risk to other users.
You may close your account at any time from Settings.
13. Disclaimers & Limitation of Liability
Niutoyuis provided on an “as is” basis. We do not guarantee that the service will be uninterrupted, error-free, or that any item listed will meet a buyer's expectations beyond what is covered by Buyer Protection.
To the maximum extent permitted by Ghana law, our total liability for any claim arising from your use of the service is limited to the fees you paid us in the three months before the event giving rise to the claim.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms and update the “Last updated” date below. Material changes will be notified to you by email or in-app at least 14 days before they take effect, where practicable.
15. Governing Law & Disputes
These Terms are governed by the laws of Ghana. Any dispute arising out of or in connection with these Terms or your use of the service will be submitted to the exclusive jurisdiction of the courts of Accra, save where you have a non-waivable consumer right to bring proceedings in your local court.
